Agreement To Terms

These Terms of Service are a legal agreement between you and Gazing Green LLC, a New Jersey limited liability company (“Gazing Green,” “we,” “us,” or “our”), concerning your use of the gazinggreenbeauty.com website and any related pages, emails and text messages (together, the “Site”). By using the Site, placing an order, or signing up for our emails or texts, you agree to these Terms and to our Privacy Policy, Shipping Policy and Refund Policy. IF YOU DO NOT AGREE, PLEASE DO NOT USE THE SITE.

The Site is intended for adults who are at least 18 years old. We sell and ship to addresses in the United States only.

INTELLECTUAL PROPERTY RIGHTS

The Site, its text, photos, videos, logos, the name Gazing Green and our designs belong to Gazing Green LLC or our licensors and are protected by law. You may view and share our content for personal, non-commercial use with credit and a link. You may not copy, sell or reuse it commercially without written permission.

PRODUCTS

Gazing Green Hair Elixir is a cosmetic hair and scalp oil. It is not a drug and is not intended to diagnose, treat, cure or prevent any disease or condition.
We describe our products as accurately as we can. Colors, scents and packaging may look slightly different from photos on your screen. Product information, including ingredients, is on the bottle and on the product page.
Results vary. Everyone’s hair and scalp are different, and experiences shared in reviews, social posts or by our founder are individual experiences, not promises of results.
Our founder’s and our customers’ stories are shared to connect and inspire, not to make medical claims.

PRODUCT USE AND SAFETY

For external use only. Avoid contact with eyes. Do not swallow.
Patch test first. Before first use, test a small amount on a small area of skin and wait 24 hours.
Stop using the product and contact a healthcare provider if you have irritation, redness, a rash or any other reaction. Keep out of reach of children.
Check the ingredient list for anything you are allergic to. The formula contains plant oils and essential oils. If you are pregnant, nursing, under medical care, or have a scalp condition, ask your healthcare provider before use.
If you have a reaction or a concern about a product, tell us at contactus@gazinggreenbeauty.com with your order number and, if you can, photos and the batch/lot number on the bottle. We keep records of reports and will respond promptly.

PURCHASES AND PAYMENT

When you place an order you are making an offer to buy. We accept it when we ship it. We may refuse or cancel an order, for example if an item is out of stock, a price or description was posted in error, we suspect fraud or a bot order, or we cannot verify your information. If we cancel after you pay, we will refund you.
Prices are in US dollars and may change without notice. Taxes and shipping are shown at checkout.
Payments are processed securely by Shopify and its payment partners. We never see or store your full card number. Accepted payment methods are those shown at checkout.
You agree to give accurate billing and shipping information.

CORRECTIONS

Occasionally the Site may contain typographical errors or inaccuracies, including in product descriptions, pricing, availability or promotions. We may correct errors and update information at any time without notice. If an order was placed at a mistaken price, we may cancel it and will refund you in full.

RETURN/REFUNDS POLICY

Please read our Shipping Policy and Refund Policy. They are part of these Terms. Risk of loss passes to you when the carrier delivers the package to the address you gave us, except where the law says otherwise.

DIGITAL PRODUCTS

If we offer digital products (for example an ebook), they are delivered electronically. Because they cannot be returned, all digital sales are final once delivered, except where the law requires otherwise or the file does not work, in which case contact us and we will fix it.

PROMOTIONS AND DISCOUNT CODES

Promotions and codes (for example free shipping, percent-off or bundle offers) apply only as stated in the offer, such as in an ad, email, popup or at checkout.
Unless stated otherwise, a code is for one use per customer, for US orders, cannot be combined with other discounts, has no cash value, and cannot be applied after an order is placed.
If an offer states an end date, that is the real end date. We may cancel orders or codes that appear to abuse an offer.
Offer details are posted where the offer is promoted. We do not need to change these Terms each time we run a promotion.

ELECTRONIC COMMUNICATIONS: EMAIL AND TEXT MESSAGES

Email: by joining our list you agree to receive marketing emails. Every email has an unsubscribe link. See our Privacy Policy.
Text messages (SMS): by entering your mobile number and signing up for texts, you agree to receive recurring automated marketing text messages from Gazing Green (for example promotions and cart reminders) at the number you gave us, including messages sent with an automatic dialer. Consent is not a condition of any purchase.
Frequency: varies. Cost: message and data rates may apply.
Opt out: reply STOP at any time. Help: reply HELP or email contactus@gazinggreenbeauty.com.
Carriers are not responsible for delayed or undelivered messages.
We do not sell or share mobile numbers or text opt-in data with third parties or affiliates for their own marketing. See our Privacy Policy.

GUIDELINES FOR REVIEWS AND CONTENT YOU SEND US

We welcome honest reviews, good or critical. We do not remove reviews because they are negative.
When you post a review, photo or other content, you keep ownership but give us a non-exclusive, free, worldwide licence to display it on our site, in emails and on our social channels, with your name shown as first name and last initial, unless you ask us to remove it.
You promise your content is yours to share, is truthful about your own experience, and does not include anything unlawful, harassing, hateful, spam, or about another person’s private information.
We may decline to publish or may remove content that breaks these rules or makes health or medical claims we cannot support (for example claims that a product treats a medical condition). We apply this rule to all reviews, positive or negative.

PROHIBITED ACTIVITIES

Please do not: use the Site unlawfully; try to break, scan or overload it; use bots or scripts to place orders, create accounts or collect data; submit false orders or card details; or interfere with other customers’ use of the Site.

TERM AND TERMINATION

These Terms stay in effect while you use the Site. If you break these Terms or the law, including through fraud, abuse or bot activity, we may block or limit your access to the Site, cancel your orders, or close your account, with or without notice. If we cancel an order you have already paid for, we will refund you. You may stop using the Site at any time.

THIRD-PARTY LINKS

Our Site may link to other sites (for example social platforms, reviews and shipping carriers). We do not control them and are not responsible for their content or policies.

USER DATA

We keep certain information you send us and information about how you use the Site so we can run the Site and handle your orders, as described in our Privacy Policy. We make regular backups, but we cannot promise that no data will ever be lost or damaged. You are responsible for the information you provide, and we are not liable for any loss or corruption of data you send through the Site.

DISCLAIMER

The Site and our products are provided as described, and to the fullest extent the law allows we disclaim all other warranties, express or implied, including any warranty of fitness for a particular result. Nothing in these Terms limits any right you have under law that cannot be waived. Nothing on this Site is medical advice. See a licensed professional for any hair, scalp or health concern.

LIMITATIONS OF LIABILITY

To the fullest extent the law allows, Gazing Green LLC and its owner, employees and partners are not liable for indirect, incidental, special or consequential damages, or for lost profits, arising from your use of the Site or our products. Our total liability for any claim relating to an order is limited to the amount you paid for that order. This does not limit liability that the law does not allow us to limit, including liability for our own fraud, or for personal injury caused by a defective product.

GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Please contact us first at contactus@gazinggreenbeauty.com. Most issues can be solved quickly, and we will try to resolve any dispute informally for 30 days. If we cannot resolve it, either of us may bring the claim in small claims court, or in the state or federal courts located in Union County, New Jersey.

ACCESSIBILITY

We want everyone to be able to use our Site. If you have trouble using it, email contactus@gazinggreenbeauty.com and we will help you order another way.

MODIFICATIONS AND INTERRUPTIONS

We may change, suspend or discontinue any part of the Site at any time. We work to keep the Site available, but we cannot promise it will always be, and there may be downtime for maintenance, technical problems or reasons outside our control. We are not liable for any loss or inconvenience caused by an interruption.

We may also update these Terms. The “Last updated” date above shows the latest version. If you keep using the Site after changes, you accept them. Orders you already placed are covered by the Terms in effect when you ordered.

MISCELLANEOUS

If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a right, that is not a waiver. These Terms, with our Privacy, Shipping and Refund policies, are the full agreement between you and us about the Site.
